General Terms and Conditions

1. Scope of Application

The following terms and conditions apply to all orders in the online shop of Babygadget. Deviating agreements are subject to written approval by Babygadget. Terms and conditions valid at the time of the order shall apply respectively. Babygadget reserves the right to change these Terms and Conditions at any time.

2. The conclusion of the Contract

The offers in the online shop of Babygadget are not as binding offers to understand. A contract is only concluded by the order confirmation via email.

3. Availability and Delivery Time

Delays give the customer no right of termination of the contract or refund of the purchase price.

4. Prices

Our prices are in Swiss Francs including VAT, excluding shipping costs.

5. Payment

The ordered products remain the property of Babygadget until they have been fully paid for.

Payments must be made in Swiss francs. In case of international transfers, as a paid amount is the amount received by our bank. The bank transfer costs are with the customer. For this reason, it is recommended to make payment transfers as SEPA the EUR-CHF.

The following payment methods are available for purchasing our products: credit cards (Visa, Mastercard), Post Finance, prepayment, PayPal & payment on invoice.

Invoices must be paid within 14 days after receipt of the goods without deduction. The total amount of the order cannot exceed 120 CHF. Unauthorized deductions will be charged. The invoice amount is due in one amount. Babygadget reserves the right, without giving any reason, to refuse delivery by invoice. In case of late payment, a default interest of 10% per annum plus a fee of 15 CHF from the second reminder will be charged. Reminders are sent by e-mail. Babygadget is entitled to default in payment of the customer to assign the claim at cost to the customer to a debt collection company. The assertion of further damages remains reserved. 

6. Delivery, testing, notification of defects

Deliveries will be sent by post to the address specified by the customer in the order. Invoicing is done per post. With the dispatch, the use and risk are transferred to the customer, as far as this is legally permissible.

If the delivery is undeliverable or the customer refuses to accept the delivery, Babygadget may terminate the contract by e-mail to the customer after setting a notice of defects and setting an appropriate deadline, as well as charge the costs for the activities.

The customer is obliged to inspect delivered goods within 5 working days after receipt of goods and to make any defects, for which Babygadget warrants, immediately in writing by email.

7. Shipping

Shipping in Switzerland and the Principality of Liechtenstein is carried out with the Swiss Post. We deliver orders from 50 CHF with B post free of charge and CHF 9.00 for A post. 

8. Right of Withdrawal

The customer can revoke his order without giving reasons by a return of the goods within 7 days of receipt of the goods. The return will be at customer's cost and risk.

The goods must be in perfect and intact condition and in original packaging. The labels must not be removed.

In General; incomplete, corrupted by the customer or contaminated goods are not returnable.

9. Privacy Policy

Every person is entitled to privacy and protection from misuse of their personal data. Babygadget includes these provisions. Personal data are strictly confidential and not sold to any third party or next given.

In close cooperation with our hosting provider, we strive to protect the databases as well as possible against unauthorized access, loss, misuse or falsification.

Following data in log files are stored when you access our Website: IP address, date, time, browser request, and general information to the operating system or browser. These data form the basis for statistical, anonymous evaluations so that trends are apparent, by which we can improve our offerings accordingly.

10. Privacy Statement for the use of Facebook plugins (Like button)

Our website used Google Analytics, a Web analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.
